Welcome to the Desert Seeds website (the “Website”). These Terms and Conditions (“Terms”) govern your access to and use of the Website, including any content, functionality, and services offered on or through the Website. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website.
Desert Seeds, headquartered in Dubai, UAE (referred to as “we,” “us,” or “our”), reserves the right to modify these Terms at any time. We will notify you of changes by posting the updated Terms on this page. Your continued use of the Website after changes constitutes acceptance of the revised Terms.
1. Use of the Website
You must be at least 18 years old to use the Website.
You agree to use the Website only for lawful purposes and in compliance with all applicable laws, including UAE federal laws and Dubai local regulations.
You are responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and comply with them.
Prohibited activities include: uploading harmful content, interfering with the Website’s functionality, or engaging in unauthorized commercial activities.
2. Intellectual Property
The Website and its entire contents, features, and functionality (including but not limited to text, graphics, logos, images, and software) are owned by Desert Seeds or its licensors and are protected by UAE and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
Limited license: We grant you a non-exclusive, non-transferable, revocable license to access and use the Website for personal and non-commercial purposes.
3. User Accounts and Security
To place orders or access certain features, you may need to create an account. You agree to provide accurate information and keep your login credentials confidential.
You are responsible for all activities under your account. Notify us immediately of any unauthorized use.
We reserve the right to suspend or terminate accounts for violations of these Terms.
4. Orders, Payments, and Pricing
All product descriptions, prices, and availability are subject to change without notice. We strive for accuracy but are not liable for errors.
Orders are subject to acceptance and availability. We may cancel orders due to stock issues, pricing errors, or other reasons.
Payments are processed securely via accepted methods (e.g., credit cards, bank transfers). All prices are in AED and exclude VAT (5% UAE VAT applies unless exempt).
Title to products passes upon full payment and delivery.
5. Shipping and Delivery
We ship within the UAE and GCC via trusted logistics partners. Delivery times are estimates (typically 3-7 business days) and not guaranteed.
Shipping costs are calculated at checkout. Risk of loss transfers to you upon delivery.
International shipping may incur additional duties; you are responsible for compliance with import regulations.
6. Returns and Refunds
Due to the perishable nature of seeds and agricultural products, returns are limited to defective or incorrect items within 7 days of delivery.
Contact us for return authorization. Refunds will be issued to the original payment method within 14 days, minus shipping costs.
Non-returnable items include opened seed packets or customized bundles.
7. Warranties and Disclaimers
Products are warranted to conform to descriptions and meet quality standards (e.g., 98%+ purity per ISTA guidelines). No other warranties, express or implied, including fitness for a particular purpose.
The Website is provided “as is” without warranties of any kind. We disclaim liability for interruptions, errors, or viruses.
Seeds are for agricultural use only; we are not liable for crop failure due to improper planting, environmental factors, or misuse.
8. Limitation of Liability
To the fullest extent permitted by UAE law, Desert Seeds shall not be liable for indirect, incidental, or consequential damages arising from use of the Website or products.
Our total liability shall not exceed the amount paid by you for the product in question.
9. Indemnification
You agree to indemnify and hold harmless Desert Seeds from any claims, losses, or damages arising from your violation of these Terms or misuse of the Website.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved exclusively in the courts of Dubai.
We encourage informal resolution; contact us before initiating legal action.
11. Miscellaneous
These Terms constitute the entire agreement between you and Desert Seeds.
If any provision is invalid, the remaining provisions remain in effect.
Our failure to enforce any right does not waive it.
